Alexander Morell überprüft die tatsächliche Wirksamkeit des Beibringungsgrundsatzes. Er beschreibt das Erkenntnisverfahren als strategische Interaktion zwischen den Parteien und dem Richter, die unter dem Beibringungsgrundsatz zwei Mechanismen der Informationsgewinnung umfasst. Diese beruhen beide auf dem vom Beibringungsgrundsatz ins Zentrum gerückten Antagonismus der Parteiinteressen und klären zusammen äußerst wirksam auf. Neben dem sogenannten Vereinigungsmechanismus, nach dem der Richter die Vereinigungsmenge der – gegebenenfalls bewiesenen – Behauptungen der Parteien als Sachverhalt zu Grunde legt, wirkt im Zivilprozess auch das sogenannte Grossman'sche Schließen. Dieses ermöglicht es dem Richter unter bestimmten Bedingungen, aus der Nichtvorlage von Beweismitteln durch die nicht beweisbelastete Partei zutreffend auf den Sachverhalt zu schließen. Das Werk wendet die aufgefundenen Einsichten zur Illustration auf Beweisprobleme im Kontext des Dieselskandals an und lotet Implikationen für das allgemeine Beweisrecht aus.

The law can only protect citizens from the legal wrongdoings of others in so far as the facts of a case can be clarified. If the principle of disclosure is set out in such a way that it prevents clarification, citizens are effectively deprived of their rights vis-à-vis third parties. Alexander Morrell is therefore in favour of an interpretation of the principle that encourages clarification, protects secrets, fits well into the procedural system, and also eliminates old inconsistencies. If this were to be recognised, it would become less attractive to violate the rights of others in the future.
