Die Arbeit setzt sich mit der Frage auseinander, in welcher Weise die EU Einfluss auf die Medienvielfaltsicherung der Mitgliedstaaten nehmen kann. Dabei wird grundlegend herausgearbeitet, dass der EU auf diesem Gebiet keine Regelungskompetenz zukommen kann. Dies ergibt sich schon aus der Achtungspflicht bezüglich der nationalen Identitäten der Mitgliedstaaten. Dennoch stellt die Medienvielfalt einen so grundlegenden Wert des Unionsrechts dar, dass die EU gehalten ist, Gefährdungen derselben aufzuspüren und diesen entgegenzutreten. Insoweit kann Art. 2 EUV auch eine kompetenzübergreifende Wirkung entfalten. Da die Sicherung der Medienvielfalt jedoch in vertretbarer Weise unterschiedlich durch die zuständigen mitgliedstaatlichen Gesetzgeber ausgestaltet werden kann, müssen europäische Vorgaben sich auf unabdingbare Mindeststandards beschränken. Zur Identifizierung solcher Mindeststandards kann insbesondere Art. 10 EMRK herangezogen werden. / The author analyzes how the European Union (EU) can influence the protection of media pluralism in its member states. There is, however a tradeoff between the EU’s need to regulate the media pluralism, and the sovereignty of each of the member states, which can limit EU’s reach regarding regulative protection measures. Nevertheless, the perspective of the supervision of values opens possibilities how the European Union can develop and apply its influence in this regard. The book presents and discusses this trade-off and these possibilities.
