Seit Anfang 2010 wird das Insolvenzverfahren einer umfangreichen, dreistufi gen Reform unterworfen: In der ersten Stufe sollten die Reformen des Planverfahrens und der Eigenverwaltung vorgenommen und ein Restrukturierungsverfahren für systemrelevante Kreditinstitute eingeführt werden, in der zweiten Stufe steht die Reform des Verbraucherinsolvenzverfahrens u.a. mit dem Ziel einer Abkürzung der Wohlverhaltensperiode an und in der dritten Stufe sollen Regelungen über die Konzerninsolvenz und das Zulassungsverfahren für Insolvenzverwalter geschaffen werden. Das Restrukturierungsverfahren für systemrelevante Kreditinstitute ist am 1.1.2011, das "Gesetz zur weiteren Erleichterung der Sanierung von Unternehmen" (ESUG) am 1.3.2012 und das "Gesetz zur Verkürzung des Restschuldbefreiungsverfahrens und zur Stärkung der Gläubigerrecht" im Wesentlichen am 1.7.2014 in Kraft getreten. Für die Konzerninsolvenz liegt inzwischen der Regierungsentwurf vor.
