Diese Arbeit unternimmt den Versuch, die zentralen Probleme des türkischen Obligationengesetzes in Bezug auf sein ursprünglich aus dem schweizerischen Recht stammendes Kauf- und allgemeines Leistungsstörungsrecht im Lichte des CISG, BGB und der europäischen Regelwerke darzustellen. Zentral ist die Frage, ob und gegebenenfalls inwieweit der türkische Gesetzgeber im neuen türkischen Obligationengesetz die Grundentscheidungen des europäischen Leistungsstörungsrechts berücksichtigt. Zunächst werden insbesondere die schon anerkannten Grundsätze des europäischen Leistungsstörungsrechts im Lichte des CISG, BGB und der europäischen Vertragsrechtsharmonisierung (PECL, DCFR, CESL-Entwurf) dargestellt. Diese Grundsätze werden anschließend mit den Entscheidungen des türkischen Gesetzgebers verglichen.
