Schon nach Abschluß der Römischen Verträge von 1957 forderten die Bundesländer ein Mitbestimmungsrecht bei EG-Vorhaben, v.a. in Angelegenheiten, die in die Ländergesetzgebungskompetenz fallen. Dieses Recht wurde in einem Zustimmungsgesetz zu den Römischen Verträgen festgelegt, das aber nur eine Informationspflicht der Bundesregierung gegenüber Bundestag und Bundesrat beinhaltete. In einem Briefwechsel von 1979 zwischen Bundeskanzler und Vorsitzendem der Ministerpräsidentenkonferenz wurde ein weitergehendes Beteiligungsverfahren der Länder vereinbart. Nach Vorliegen des Textes der Einheitlichen Europäischen Akte (EEA) wurden im Artikel 2 des Zustimmungsgesetzes zur Akte die Mitwirkungsrechte des Bundesrats (insbesondere sein Recht zur Stellungnahme) gesetzlich verankert.
