Unbeschadet vorsichtiger Schritte hin zu einer grenzüberschreitenden Öffnung bleibt die körperschaftsteuerliche Organschaft im Kern binnenorientiert. Damit kontrastiert das deutsche Organschaftsrecht nicht nur mit der zumeist multinationalen Konzernwirklichkeit, sondern steht im Verdacht, gegen die im Unions- und Abkommensrecht normierten Diskriminierungsverbote zu verstoßen. Aufbauend auf einer tiefgehenden Analyse der unionsrechtlichen Anforderungen an eine grenzüberschreitende Konzernbesteuerung untersucht der Verfasser, inwieweit die einzelnen Tatbestandsvoraussetzungen zur Begründung eines Organkreises mit der Niederlassungsfreiheit in Einklang stehen. Zudem beleuchtet der Verfasser die Vereinbarkeit des Organschaftsrechts mit den zuvörderst für Drittstaaten-Sachverhalte relevanten abkommensrechtlichen Diskriminierungsverboten. Der Autor Matthias Pick hat an der Johannes Gutenberg-Universität Mainz Wirtschaftswissenschaften studiert und bei Prof. Dr. Roland Euler promoviert. Er ist derzeit im Konzernrechnungswesen eines großen deutschen Unternehmens der chemischen Industrie tätig.
