Parce que les traités constitutifs de l'Union ont pour objet la construction du Marché intérieur et d'un marché unique, des directives Marchés publics ont été adoptées par les institutions de l'Union pour participer de façon systématique à l'intégration économique, sociale et politique des Etats membres. Le dispositif normatif européen en matière de marchés publics, dispositif juridique autonome et fonctionnel, repose sur des concepts juridiques difficiles à cerner et des dispositions généralement incomplètes. La juridiction suprême de l'Union, la Cour de justice de l'Union européenne, a par conséquent été amenée à préciser les directives Marchés publics en interprétant leurs dispositions à la lumière des exigences du droit primaire. En d'autres termes, l'imprécision des concepts juridiques (en particulier celui de marché public) autant que le caractère lacunaire des directives l'ont poussée à compléter par sa jurisprudence, de façon substantielle, le droit de l'Union des marchés publics. Partant, le juge de l'Union dit le droit en ce domaine. La riche production jurisprudentielle de la Cour en matière de marchés publics expose donc à la lumière la question de l'apport de cette juridiction, à travers son activité d'interprétation, à l'oeuvre d'élaboration normative en matière de marchés publics. Ce qui conduit, dès lors, à analyser l'essence et la portée de l'interprétation de la Cour de justice en droit de l'Union des marchés publics
