I. Das Verhältnis der Parteien zum öffentlichen Dienst findet seit den frühen siebziger Jahren in der wissenschaftlichen und politischen Diskussion der Bundesrepublik zunehmend Beachtung. "Die Spatzen pfeifen es von den Dächern«, schrieb Josef Isensee 1982, "daß hierzulande die Besetzung öffentlicher Ämter und die Karrieren im öffentlichen Dienst oftmals von der Gunst oder Mißgunst der jeweils regierenden Partei abhängen, daß die Parteipatronage heute auf allen Ebenen der Staatlichkeit um sich greift, vom Bund abwärts bis zu den Gemeinden. «1 Die öffentlichen Verwaltungen sind von den Parteien 2 durchdrungen , und die Karrieren im öffentlichen Dienst werden wesentlich von den Parteien beeinflußt, so daß eine Parteimitgliedschaft für öffentlich Bedienstete ein bedeutsamer - und nicht selten der entscheidende - Faktor in ihrer beruflichen Karriere ist. Bei einer Befragung von Beamten des höheren und gehobenen allgemeinen, nicht technischen Dienstes in den Jahren 1970/71 in Nordrhein-Westfalen nannten 42 Prozent (n = 530) die parteipolitischen Bindungen als wesentliche Voraussetzung für einen erfolgreichen 3 Verlauf der beruflichen Karrieren im öffentlichen Dienst - So wie einerseits die Parteien und die Parteipolitik wesentlich den öffentlichen Dienst und die dort Beschäftigten beeinflussen, so beeinflussen andererseits die öffentlich Bediensteten die Parteien und deren Politik. Einer hauptberuflichen Spitzenposition in der Politik liegt in der Bundesrepublik häufig eine berufliche Tätigkeit im öffentlichen Dienst zugrunde, und die Führungspositionen in den großen Parteien sind auf allen Ebenen (Bund, Länder, Gemeinden) überproportional mit Beschäftigten des offentlichen Dienstes besetzt
