Die Aufrechnung als Instrument der Rechtsdurchsetzung findet nicht nur im Privatrechtsverkehr zahlreiche Anwendungsfälle. Aufrechnungslagen und Aufrechnungsbedürfnisse bestehen auch im Geltungsbereich des öffentlichen Rechts. Während die Aufrechnung im öffentlichen Recht eine inzwischen beachtliche verwaltungsrechtliche Literatur hervorgebracht hat, fehlt es an einer grundsätzlichen Auseinandersetzung mit den relevanten verfassungs- und europarechtlichen Aspekten einer Aufrechnung zwischen Hoheitsträgern. Sowohl im bundesdeutschen als auch im europäischen Mehrebenensystem stellt sich die Frage nach der Zulässigkeit einer solchen Aufrechnung. Die vorliegende Arbeit geht der Frage nach, wie sich die vollstreckungsähnliche Funktion der Aufrechnung auf ihre Anwendung zwischen Hoheitsträgern auswirkt und ob es spezifische Konstellationen gibt, in denen eine Aufrechnung zwischen Hoheitsträgern unzulässig ist. / »Set-Off between State Entities.
