Die individuelle Erstellung oder Anpassung von Softwarelösungen ist für Auftraggeber wie Auftragnehmer zumeist mit erheblichen wirtschaftlichen Risiken verbunden. Darüber hinaus wirft die rechtliche Behandlung solcher komplexen Langzeitprojekte zivilrechtliche Fragestellungen auf, für die weder das Bürgerliche Gesetzbuch (BGB) noch das spanische Zivilgesetzbuch, der Código Civil, ausdrückliche Regelungen enthält.
