Der Einkünftetatbestand der sonstigen selbständigen Arbeit in § 18 Abs. 1 Nr. 3 EStG wird nach heute allgemeiner Ansicht eng ausgelegt. Eine Tätigkeit kann demnach nur dann unter diesen Tatbestand fallen, wenn sie den drei im Gesetz genannten Tätigkeiten (Testamentsvollstreckung, Vermögensverwaltung, Aufsichtsratstätigkeit) ähnlich ist. Der Autor untersucht anhand der klassischen Auslegungsmethoden, ob diese Ansicht haltbar ist. Er kommt insbesondere durch Heranziehung der historischen Vorläufernormen zu dem Ergebnis, dass die sonstige selbständige Arbeit einen erheblich größeren Anwendungsbereich hat, nämlich dass jede unabhängig und höchstpersönlich ausgeübte Tätigkeit die Voraussetzungen der Norm erfüllt. Nach Auffassung des Autors bilden somit die Einkünfte des § 18 Abs. 1 Nr. 3 EStG und nicht – wie allgemein angenommen – die Einkünfte aus Gewerbebetrieb gemäß § 15 EStG den Grundtatbestand der sog. Gewinneinkünfte (d.i. Land- und Forstwirtschaft, Gewerbebetrieb, selbständige Arbeit). / »The Basic Type of Profit Income. An Interpretation of Section 18 (1) no. 3 of the German Income Tax Act« -- So far Section 18 (1) no. 3 of the German Income Tax Act (»Income from other self-employment«) has been rather inconspicuous within the tax law practice. The author, however, reaches the conclusion, using the classical methods of interpretation, that this provision constitutes the basic form of the so-called profit income (i.e. agriculture and forestry, trade, self-employment).
