Die Energiewende, die klimapolitischen Ziele sowie die Sicherung der Versorgung bedingen einen technologischen Wandel in der Energiewirtschaft. Neben klassische Untergrundnutzungen wie die Förderung von Kohlenwasserstoffen treten vermehrt neue Nutzungen wie die Speicherung von CO2, Druckluft oder Wasserstoff oder die Nutzung der Geothermie auf. Raum im Untergrund ist jedoch – wie an der Oberfläche – eine begrenzte Ressource. In der Folge ist eine Zunahme von unmittelbaren und mittelbaren Konkurrenzsituationen bereits heute absehbar. Sind die Genehmigungsverfahren des BBergG und des im August 2012 in Kraft getretenen KSpG geeignet diese Konkurrenzen abzubilden? Sind die Instrumente der Raumordnung und -planung für eine Lösung nutzbar? Gibt es rechtspolitischen Handlungsbedarf? Der Autor diskutiert diese aktuellen Fragen und entwickelt vor dem Hintergrund des ROG Lösungen, um dem Befund einer ansteigenden Nutzungsverdichtung gerecht zu werden.
