Im Zuge zahlreicher technologischer Entwicklungen ist es dem Staat zunehmend möglich, digitale Entscheidungssysteme einzusetzen, die auf Algorithmen basieren, auf umfassende Datenbestände zurückgreifen können und sich durch erhebliche Komplexität, Effizienz und Variabilität hinsichtlich ihres Einsatzes auszeichnen. Das etablierte Thema der Automatisierung in Staat und Verwaltung unterliegt im Zuge der gegenwärtigen soziotechnischen Transformationsprozesse neuen Dynamiken und stellt den Anlass der Arbeit dar. Ausgehend von einer kritischen Betrachtung des juristischen Verständnisses von Entscheidungen und Entscheidungsbildung wird der Bedarf einer interdisziplinär offenen Rechtswissenschaft nach einer analytischen De- und Rekonstruktion der sich wandelnden staatlich-exekutiven Entscheidungsgebilde festgestellt. Für diese Zwecke wird unter Beachtung rechtsstaatlicher Anforderungen an Kontrolle und Individualrechtsschutz die interdisziplinär informierte, 'deskriptive Systematik der Entscheidungsarchitektur' eingeführt, deren Anwendung die Herleitung konkreter verfassungsrechtlicher Ergebnisse sowie konstruktive, interdisziplinäre Analysen komplexer staatlicher Entscheidungsbildung ermöglicht
