Nicht erst seit der jüngsten Finanz- und Wirtschaftskrise ist die Behandlung von Sicherungsrechten in der Insolvenz eines international tätigen Unternehmens von rechtlich wie wirtschaftlich höchster Bedeutung. Das Werk zeigt auf, dass die Verschiedenheit der nationalen Sachenrechtsordnungen oftmals dazu führt, dass ein Sicherungsrecht nach einem Ortswechsel des Sicherungsguts im neuen Belegenheitsstaat nicht anerkannt wird. Der Autor untersucht die unterschiedlichen Ansätze, diese Problematik zu überwinden und verdeutlicht, dass nur eine materiellrechtliche Harmonisierung zielführend sein kann. Ausgangspunkt der Analyse des internationalen Insolvenzrechts ist die Auslegung der für dingliche Sicherungsrechte maßgeblichen Vorschriften der Artt. 5, 7 EuInsVO sowie des § 351 InsO. Hierauf aufbauend werden eingehend die unterschiedlichen Fallkonstellationen untersucht, der sich Sicherungsnehmer und Insolvenzverwalter ausgesetzt sehen können. Abschließend werden von der geltenden Rechtslage abweichende Vorschläge zur Behandlung dinglicher Sicherheiten im internationalen Insolvenzrecht bewertet und nochmals die Notwendigkeit einer materiellrechtlichen Harmonisierung herausgestellt
