Der Klimaschutz ist derzeit in aller Munde – auch und besonders in Rechtsfragen. Doch nicht nur das Energierecht als naheliegendes Rechtsgebiet muss dem Klimawandel begegnen, sondern sämtliche Rechtsgebiete, die eine flankierende Funktion ausüben können, müssen hierfür herangezogen werden. Für jedes Rechtsgebiet muss also geprüft werden, ob es dazu beitragen kann, den Klimaschutz zu fördern oder Maßnahmen zu treffen, die der Anpassung an den Klimawandel dienen. Die Autorin untersucht dementsprechend anhand verschiedener klimaschutzbezogener Gesetze, welchen Beitrag das Baurecht in diesem Zusammenhang leisten kann. Zum Tragen kommen dabei unter anderem das Europarechtanpassungsgesetz Bau 2004, das Gesetz zur Förderung des Klimaschutzes bei der Entwicklung in den Städten und Gemeinden sowie verschiedene landesrechtliche Entwürfe.
