Die Untersuchung behandelt die arbeitsrechtlichen Aspekte bei der Einführung einer Ethikrichtlinie und Whistleblowing-Hotline im Rahmen des Compliance-Managements. Im Zentrum der Arbeit steht neben der Einführung eines Verhaltenskodex die so genannte Whistleblower-Klausel, d.h. die in der Ethikrichtlinie statuierte Anzeigeverpflichtung, wonach Verstöße gegen den Kodex zu melden sind. Zentrale Fragestellung der Arbeit ist, inwieweit sich eine Verpflichtung zur Anzeige des Fehlverhaltens Dritter aus den vertragsimmanenten Nebenpflichten des Arbeitnehmers ergibt. Besteht eine Verpflichtung des Arbeitnehmers zum internen Whistleblowing aufgrund arbeitsvertraglicher Rücksichtnahmepflichten nach §§ 242, 241 Abs. 2 BGB? Die Untersuchung liefert konkrete Ergebnisse und eröffnet damit die Diskussion.
