Lassen sich familieninterne Erbstreitigkeiten im Wege eines interessenbasierten Mediationsverfahrens besser lösen als mit Hilfe eines Zivilrechtsprozesses? -- Zur Beantwortung dieser Frage stellt Ruth Chr. Siegel zunächst verschiedene Konfliktfelder dar, die im Rahmen von Erbstreitigkeiten auftauchen können. Dabei arbeitet sie die Abhängigkeit der möglichen Konfliktpunkte von der Zusammensetzung der mit einer Erbstreitigkeit befassten Familienmitglieder sowie von deren Standpunkten und - z. T. immateriellen - Interessen heraus. Im Anschluss daran zeigt die Autorin die Schwierigkeiten auf, die sich aus eben diesen Konstellationen für einen prozessualen Lösungsansatz ergeben können. Den Hauptteil der Untersuchung bildet die Darstellung einer Erbmediation einschließlich der einzelnen zu durchlaufenden Verfahrensphasen anhand eines Beispielfalles. Die im Rahmen dieses Verfahrens zu erzielenden Ergebnisse werden in Relation zu den jeweiligen Möglichkeiten gesetzt, die im Rahmen eines Zivilprozesses bestehen, familieninterne Erbstreitigkeiten beizulegen. -- Überlegungen zu Zulässigkeit und Zweckmäßigkeit letztwilliger Mediationsklauseln sowie zu Regelungen der vorweggenommenen Erbfolge führen zu dem Schluss, noch bessere Lösungen als in einem Mediationsverfahren nach dem Erbfall gemeinsam mit dem späteren Erblasser bereits vor dessen Tod im Rahmen eines interessenbasierten Verfahrens erzielen zu können. Die Autorin schließt nach entsprechender Erörterung die Arbeit mit der Empfehlung, Erbstreitigkeiten in den Katalog des § 15a EGZPO aufzunehmen.
