Prozedurales Recht stellt sich als gesetzliche Regelungstechnik dar, welche sich verfahrensförmiger Abläufe bedient, um rechtliche Flexibilität zu erreichen. Es gelangt vermehrt dann zum Einsatz, wenn tatsächliches Wissen fehlt oder aber – auch ethisch behaftete – schwer entscheidbare Fragen im Kontext eines zunehmenden Pluralismus beantwortet werden müssen. Die Arbeit liefert einen Beitrag zur Untersuchung dieser Regelungstechnik zum Schutz des menschlichen Lebens im interdisziplinär geprägten Medizinstrafrecht. Dabei werden insbesondere die strafrechtlich sehr umstrittenen Bereiche des Schwangerschaftsabbruchs, der Präimplantationsdiagnostik sowie der Sterbehilfe untersucht. Die Autorin kommt dabei zu dem Ergebnis, dass die einzelnen prozeduralen Lebensschutzkonzepte aus unterschiedlichen Gründen zwar durchaus auf prozedurale Strukturen angewiesen sind, die dogmatische Umsetzung der prozeduralen Strategie in die einzelnen Regelungskomplexe jedoch nicht überzeugt. / »Procedural Life Protection Concepts of Medical Criminal Law. An Analysis of the Procedural Regulations at the Beginning and End of Criminal Life Protection« -- Procedural life protection concepts represent a legal strategy to realize criminal law protection despite actual and/or empirical uncertainties at the beginning and end of human life. The author concludes that the individual, selected areas of medical criminal law are dependent on procedural structures. However, the inclusion of procedural elements in the individual regulatory complexes is not convincing from a dogmatic perspective.
