Content: "This book is designed primarily for the classroom and not for in-depth research on the topic of private international law. To be sure, it can certainly be used as a reference insofar as it includes most of the classic judicial opinions, key statutes, significant international agreements, and other building blocks. But with the exception of this introductory chapter, every effort has been made to avoid unnecessary footnoting and academic clutter. Footnoting in cases is generally excluded, and scholarly references in the extensive Notes & Questions are largely limited to less accessible or milestone sources and commentary. Instead of extensive citations to scholarly writings, readers are encouraged to consult leading sources, especially the American Law Institute's First, Second, and Draft Third Restatements on Conflict of Laws, for discussion and citations on specific points of law as well as treatises on the subject. This book is also distinctive in that it blends national cases and materials (primarily from the United States but also from other legal systems) with international ones. It is no longer sensible to divide the conflicts discipline into "domestic" and "international" components. Content: In the last decade of globalization, States in the Middle East, East Asia, Europe, and North America have looked towards Africa and Southeast Asia for opportunities to lease for 30-50 years large tracts of arable land for production of commodity crops and biofuels in order to meet the needs of home markets. Facing their own governance challenges, States in Africa and Southeast Asia have leased land to private foreign investors without requiring any environmental review or mitigation of the proposed land leases. This paper argues that in food insecure states the recent flurry of land leasing activity to foreign agribusiness is likely to lead to unintended long term consequences for the ecology in land-leasing States by depleting the already fragile environment through monocropping, chemical pesticide and fertilizer applications, and large scale irrigation. This paper argues that international investment law may provide foreign investors with legal protection if land leasing States in the future decide to regulate the leases in a manner that discriminates against large agribusiness. The current proposals for self-regulatory voluntary codes of conduct do not provide sufficient oversight over the leasing process to protect the public's interest in a healthy and productive environment against foreign investors who have under the current lease structure no incentive to improve the land that they are leasing. The creation of an United Nations based ombudsman to provide legal and technical oversight and support for States making long-term leases has greater potential than a voluntary code for ensuring a balanced negotiation among the interests of host State governments for investment, investors for arable land, and the public for long-term sustainability.

Content: There is an ever-present threat of catastrophic marine pollution incidents, as illustrated by recent disasters such as the Deepwater Horizon oil spill in the Gulf of Mexico. Even small-scale accidental pollution discharges can have long-term consequences for marine and coastal resources. The UN Convention on the Law of Sea obliges all States to cooperate to prevent accidents and to minimize environmental damage during emergencies by jointly developing and implementing marine pollution contingency plans. The Asia-Pacific is one of the world’s busiest shipping regions, some of its mega-ports experience high rates of vessel congestion, and there are increasing numbers of offshore installations.
