Unter dem Begriff «Generation Praktikum» wird die Praxis von Unternehmen verstanden, arbeitsuchende Fach- und Hochschulabsolventen als Praktikanten oder Volontäre einzustellen und sie schlecht oder gar nicht zu bezahlen. Dabei wird in der betrieblichen Praxis nicht selten gegen geltendes Recht verstoßen. Die Hauptursachen: mangelnde Transparenz, Regelungslücken und weitgehende Sanktionslosigkeit bei Missbrauch von Praktikantenverhältnissen. Die Arbeit kommt zu dem Ergebnis, dass mehr Rechtssicherheit und mehr Schutz der Praktikanten vor Ausbeutung nur durch gesetzliche Änderungen im Berufsbildungsgesetz zu erreichen sind. Erforderlich sind unter anderem eine klare Definition von Praktikantenverhältnissen, eine Gleichbehandlung von Pflichtpraktika und freiwilligen Praktika, ein Schriftformerfordernis für Praktikantenverträge sowie Beweiserleichterungen bei der gerichtlichen Durchsetzung von Ansprüchen.
