Die Europäische Kommission führt seit einigen Jahren mehrere Kartellverfahren gegen den Suchmaschinenbetreiber Google. Ziel ist es, den Umfang der Marktmacht des Unternehmens zu beleuchten und einen etwaigen Marktmachtmissbrauch zu sanktionieren. Abseits dessen fehlt es jedoch an einer umfangreichen Untersuchung, ob der Wettbewerb im Suchmaschinensektor nicht womöglich dadurch gefördert werden kann, dass den Wettbewerbern von Google Zugang zu den Algorithmen und Datensätzen der Google-Suchmaschine eingeräumt wird.Die Arbeit verknüpft Aspekte der Informatik, der Internetökonomie sowie des Medienkartellrechts und widmet sich im Lichte des Missbrauchsverbots des Art. 102 AEUV eben jener Frage, inwieweit im Suchmaschinensektor Wettbewerber Zugang zu den Algorithmen und Datensätzen des Marktbeherrschers Google erhalten sollten. Dabei gelangt sie unter kritischer Würdigung der Essential-Facilities-Doktrin und vor dem Hintergrund der europäischen Rechtsprechung zu einer eigenständigen Dogmatik des Marktmachtmissbrauchs durch „absolute Geschäftsverweigerung“
