Ziel der Arbeit ist es, ein einheitliches Lösungskonzept für die Konstellationen der vermeintlichen Mittäterschaft und mittelbaren Täterschaft sowie der verkannten Täterschaft zu erarbeiten. Dazu werden die hinter diesen Irrtümern stehenden Fragestellungen nach dem Versuchsbeginn bei der mittelbaren Täterschaft und der Mittäterschaft, dem Zusammenhang zwischen den Versuchsgrundsätzen und der Beteiligungslehre und der Struktur der Tätervoraussetzungen als auch der Zurechnung einer Gesamttat beleuchtet. Die Analyse ergibt, dass sich eine Zurechnung fremden Ausführungshandelns und damit eine Strafbarkeit aus dem jeweiligen Begehungsdelikt nicht begründen lässt, da ansonsten die Vergleichbarkeit der verschiedenen Täterschaftsformen aufgegeben sowie die gesetzgeberischen Wertungen und verfassungsrechtlichen Vorgaben unterlaufen würden. Des Weiteren wird untersucht, inwieweit sich etwaige Strafbarkeitslücken über eine Fahrlässigkeits-, Unterlassungs- oder Vorfeldstrafbarkeit schließen lassen. / »The Significance of Misconceptions about Circumstances that Justify Criminal Offences. An Investigation of Alleged and Unrecognized Offences« -- The paper aims to develop a holistic solution to various types of misconception in the field of teachings on criminal involvement. The focus of the investigation is on the fundamental issues after the start of the trial in terms of the direct offenders and the accomplices, the link between the principles of the trial and teachings on involvement and the structure of the requirements to identify an offender and the attribution of the whole offence.
