Traditionell ist die Postgraduiertenphase in der Rechtswissenschaft durch die Individualpromotion gekennzeichnet. Diese Form der Doktorandenausbildung sieht sich erheblichem Veränderungsdruck ausgesetzt. In den Medien und der Disziplin selbst haben Plagiatsskandale die Kriterien der Auswahl der Promovierenden, die Betreuung sowie die Notenvergabe auf den Prüfstand gestellt. Dissertationen als Forschungsleistungen sind dabei mit einer Diskussion über die Forschungsausrichtung des Faches zwischen Professions- und Wissenschaftsorientierung konfrontiert. Die Hochschulpolitik drängt auf strukturierte Promotionsprogramme. Universitäten gründen zentrale Graduierteneinrichtungen, um Nachteile im Wettbewerb um Drittmittel zu vermeiden. Auch für die Rechtswissenschaft stellen sich somit Fragen nach der Qualität ihrer Promotionen und angemessenen institutionellen Antworten auf die gegenwärtigen Probleme.
