Die sog. Verdachtskündigung ist ein wissenschaftlicher und praktischer Dauerbrenner des Arbeitsrechts. Über ihre Zulässigkeit und Dogmatik wird seit jeher lebhaft gestritten. Die Arbeit greift die Diskussion auf und behandelt die zentralen verfassungs- und einfachrechtlichen sowie methodologischen Fragen. Im Ergebnis zeigt sich, dass sich die häufig als Fremdkörper wahrgenommene Rechtsfigur bruchlos in das Recht der außerordentlichen Kündigung einfügt und viele der zu ihr vom Bundesarbeitsgericht entwickelten Obersätze überzeugen, es allerdings auch Strukturfragen – wie insbesondere die Zulässigkeit einer ordentlichen Verdachtskündigung – gibt, bei denen die besseren Argumente für andere als die durch die Rechtsprechung gegebenen Antworten sprechen
