Den Anforderungen des Beschleunigungsgebots aus der EMRK, dem Grundgesetz und dem Unionsrecht gerecht zu werden, ist auch in Strafverfahren eine diffizile Aufgabe, wenn durch den zunehmenden Einfluss des EU-Rechts bei Zweifeln eine Vorabentscheidung des Gerichtshofs der EU eingeholt werden kann bzw. sogar muss. Kathleen Maja Wolter erörtert dieses Spannungsverhältnis unter Darstellung der Grundlagen des Beschleunigungsgebots und würdigt die aktuellen Beschleunigungsbemühungen beim EuGH, insbesondere das neue Eilvorlageverfahren. Da dieses allein indes die mögliche Verletzung des Rechts auf angemessene Verfahrensdauer durch ein Vorabentscheidungsverfahren nicht verhindern kann, wird eine umfassende Lösung für Strafgerichte entwickelt, die sich - ausgehend von einer teleologischen Interpretation des Art. 267 AEUV - vor allem für eine Befassung des EuGH nur mit unionsrechtlich klärungsbedürftigen Fragen ausspricht.
