Das Umweltzeichen «Der Blaue Engel» ist in Deutschland das bekannteste Kennzeichen für umweltfreundliche Produkte. Seine Vergabe erfolgt auf Grundlage ministerieller Richtlinien unter Beteiligung des RAL Deutsches Institut für Gütesicherung und Kennzeichnung e.V., einer vom Bundesumweltminister berufenen Jury Umweltzeichen sowie des Umweltbundesamtes. Ausgehend von der wirtschaftlichen Bedeutung untersucht der Autor in seiner Arbeit die Frage, wie die Vergabe des «Blauen Engels» rechtlich ausgestaltet und ob sein Einsatz zulässig ist. Die Analyse geht dabei sowohl auf die verfassungsrechtlichen Anforderungen an den Einsatz des Zeichens als solches als auch auf die lauterkeitsrechtlichen Grenzen für die Werbung mit dem «Blauen Engel» ein. Ferner wird erörtert, in welchem Umfang das Zeichen rechtlichen Schutz genießt und inwieweit ihm eine gewährleistungsrechtliche Bedeutung zukommt.
