Note:
Der günstige Umstand, daß ich im Auftrage der Kaiserlich-Japanischen Regierung seit dem Frühjahr 1929 in Europa verweilen und mich weiteren Studien im Gebiet der Rechtsphilosophie und Soziologie widmen konnte, ermöglichte mir die Ausführung meines schon lange gefaßten Planes, die Lehre vom sozialen Verband philosophiseh zu begründen. Mit dieser Arbeit habe ich mich zuerst in Wien, dann in Freiburg i. Br. und schließlich wieder in Wien beschäftigt. Diese Aufeinanderfolge meiner Aufenthaltsorte hängt mit dem Entwicklungsgang meines Gedankens eng zusammen. Mein Streben, die Daseinssphäre des sozialen Verbandes zu ergründen, brachte mich in erster Linie mit der reinen Rechtslehre Herrn Professor HANS KELSENS und seiner "Wiener Schule" in Berührung. Die kritische Befassung mit dieser Lehre führte mich zu zwei grundsätzlichen Ergebnissen: erstens - und in dieser Hinsicht verfolge ich den von der reinen Rechtslehre gewiesenen Weg -, daß der soziale Verband als ein einheitlicher und in sich identischer, eigenständiger Gegenstand der Erkenntnis einzig und allein der Sphäre der idealen Geistesgebilde angehören kann; zweitens aber - und diese Feststellung weicht von der Lehrmeinung der reinen Rechtslehre ab -, daß der soziale Verband im allgemeinen nicht mit einem Komplex von Normen, der Staat im besonderen nicht mit der Rechtsordnung identifiziert werden darf
