Die Arbeit untersucht, wie kirchenrechtliche Regelungen auf die Arbeitsverhältnisse bei kirchlichen Arbeitgebern einwirken. Dieses Kirchenrecht soll mit unterschiedlicher Begründung unmittelbar im staatlichen Rechtskreis gelten. Die Thesen fußen auf einer falschen Vorstellung vom Kirchenrecht und von der rechtlichen Stellung der Kirchen. In der Diskussion wird zudem die begrenzte personale Reichweite des Kirchenrechts übersehen. Schon kirchliche Rechtsträger, aber auch die Arbeitnehmer unterfallen oftmals der Kirchengesetzgebung nicht unmittelbar. Eine staatliche Norm kann die beschränkte Reichweite des Kirchenrechts nicht ausweiten. -- Im staatlichen Rechtskreis wird das Kirchenrecht aufgrund der Befugnisnormen des staatlichen Rechts wirksam. Die Kirchen können sich - wie alle anderen Grundrechtsträger - der von der Rechtsordnung zur Verfügung gestellten Rechtsformen bedienen. Gestaltungsmittel zur Verwirklichung kirchlicher Selbstbestimmung sind damit v.a. das Privat- und Arbeitsrecht. / »Church Labour Law. Regulations on Loyalty Obligations and Employee representation and their Consequences in the State Legal System« -- How does church labour law affect employment relationships? This paper examines the scope of church labour law and in particular the relationship between church law and state law in terms of legal history and constitutional law. Canon law does not apply directly to the employment relationship, but only acts through the state law; this is just the instrument for the realisation of church self-determination.
