Content: Die Zivilrechtskodifizierung – ein klassisches Thema der Rechtswissenschaft – wird heute nicht nur im Einzelstaat, sondern auch auf supranationaler Ebene berücksichtigt und diskutiert. In dieser Arbeit werden die europäischen Entwicklungen der Privatrechtsvereinheitlichung mit der chinesischen Entwicklung auf dem Gebiet der Kodifikationsbemühungen im Zivilrecht verglichen, denn sie weisen zahlreiche Gemeinsamkeiten und eine ähnliche Situation auf. Zwar sind bisher keine vollständigen Zivilgesetzbücher entstanden, aber die Ergebnisse sind fruchtbar. In Europa wurde beispielsweise ein Projekt zur Schaffung eines Gemeinsamen Referenzrahmens (bekannt als Common Frame of Reference – CFR) für das europäische Privatrecht auf der EU-Ebene ins Leben gerufen und der endgültige rechtswissenschaftliche Entwurf (Draft Common Frame of Reference – DCFR) bereits 2009 in Form der sogenannten Outline Edition vorgelegt. In der VR China wurde – nach dem Erlassen des Delikthaftungsgesetzes 2009 – das Rechtsanwendungsgesetz für zivilrechtliche Beziehungen mit Auslandsbezug am 28.10.2010 als Einzelgesetz gebilligt, die verbleibende Aufgabe für die Schaffung des Zivilgesetzbuches besteht hauptsächlich nur noch darin, die Allgemeinen Grundsätze des Zivilrechts und das Eherecht zu novellieren

Series Statement: Selected Chinese Cases on the CISG

Content: This book focuses on Chinese cases on the CISG decided by Chinese courts of all levels, mainly from 1990 to 2005. During this period, the number of cases grew gradually. The total number of cases remained low, the reasons of which might be the following: parties were not familiar with the CISG hence decided to opt out of it; the case collection and report systems in China at that time were not as developed as now rendering many cases inaccessible. This book deals with the cases in the early days of the development of the CISG in China. These cases reflect how People's Court of all levels started to deal with various issues arising from the CISG and will help understand whether and how the People's Courts change their approaches to the interpretation and application of the CISG in the future
