Der kirchliche Bereich steht vor der Herausforderung neue Finanzierungsquellen zu erschließen. Zustiftungen und unselbständige Stiftungen können hierzu einen Beitrag leisten. Trotz einer Reihe noch nicht abschließend geklärter Fragen vor allem auch in Bezug auf das Institut der Zustiftung bietet das staatliche Stiftungsrecht dafür einen großen Gestaltungsspielraum. Demgegenüber vermittelt das kirchliche Recht den Eindruck, es gelte ein abschließender numerus clausus stiftungsrechtlicher Rechtsformen, der vergleichbare Gestaltungsmöglichkeiten wie im staatlichen Recht nicht zulasse. Tatsächlich ist dieser Eindruck jedoch unzutreffend. Die gesetzgeberische Intention des kirchlichen Stiftungsrechts erfordert keinen Typenzwang und damit einhergehend eine Beschränkung stiftungsrechtlicher Zuwendungsformen. Insbesondere das kirchliche Vermögensrecht strebt jedenfalls im Bereich der Schuldverhältnisse eine weitestgehende Kongruenz mit dem staatlichen Recht an und schafft damit den Raum für die Übernahme stiftungsrechtlicher Gestaltungsformen in das kirchliche Recht.

The church sector is faced with the challenge of tapping into new sources of funding. Sub-foundations and independent foundations can assist with this. Despite a number of questions that have not yet been conclusively answered, especially regarding the endowment of sub-foundations, state foundation law offers much room to manoeuvre. In contrast, canon law gives the impression that there is a final numerus clausus of legal forms of foundations that does not allow for a range of options comparable to that provided for by state law. However, this impression is, in fact, incorrect. The legislative intention of canon foundation law does not impose any type constraint and, thus, there is no restriction on forms of endowment under foundation law. In particular, canon property law strives for the greatest possible congruence with state law, at least in the area of obligations, and thus creates the space for the adoption of forms of foundation law in canon law.
