Die Reform von BRAO und StBerG (Gesetz zur Neuregelung des Berufsrechts der anwaltlichen und steuerberatenden Berufsausübungsgesellschaften sowie zur Änderung weiterer Vorschriften im Bereich der rechtsberatenden Berufe) bringt mit Wirkung zum 1. August 2022 grundlegende Veränderungen im Sozietätsrecht der Steuerberater, Rechtsanwälte, Patentanwälte und weiterer Berufe mit sich. Besonders weitreichend ist die Öffnung der Berufsausübungsgesellschaften für sämtliche freien Berufe. Damit können sich künftig etwa Rechtsanwälte mit Psychologen, Ärzten oder Ingenieuren zusammenschließen. Die Bildung freiberuflicher Konzerne wird weitergehend als bislang ermöglicht (Mehrstöckigkeit). Die Sozietäten können als solche zugelassen werden und müssen es zum Teil sogar. Das Recht der Interessenkollision wird neu gefasst, die Mehrheitserfordernisse bei interprofessionellen Gesellschaften entfallen. Im Ergebnis kommt eine große Reform der berufsrechtlichen Vorschriften. Daraus ergeben sich Risiken, vor allem aber Chancen für Steuerberater und Rechtsanwälte. Sie müssen die Fallstricke kennen, um Berufsrechtsverstöße zu vermeiden, können aber auch von der neuen Freiheit profitieren. Einige Monate vor Inkrafttreten des Gesetzes ist der richtige Moment gekommen, um sich mit dem künftigen Recht zu beschäftigen und die eigene Sozietät wie auch Gesellschaften in der Mandantschaft zukunftsgerichtet neu aufzustellen.
