In der Literatur wird teilweise behauptet, dass es einen geringen Einfluss des französischen Rechts auf die Entwicklung der deutschen Handelsgerichtsbarkeit gab. Tatsächlich unterscheiden sich die heutigen Kammern für Handelssachen des GVG stark von den französischen Handelsgerichten. Entsprechende Aussagen werden allerdings in den wenigen Werken zur Geschichte der Handelsgerichtsbarkeit nicht genauer begründet. Thomas Vogl nimmt daher diese Behauptungen zum Anlass, sich konkret mit dem Einfluss des französischen Rechts auf die Entwicklung der Handelsgerichtsbarkeit in Deutschland im 19. Jahrhundert zu beschäftigen. Dafür vergleicht er insbesondere die Napoleonische Gesetzgebung zu den Handelsgerichten mit den deutschen Handelsgerichtsordnungen bzw. Gerichtsverfassungsgesetzen des 19. Jahrhunderts. Im Zuge dessen zeigt er die verschiedenen Entwicklungsstränge in Deutschland in der Zeit von 1814 bis zur Einführung des GVG auf. / »French Influences on Germany’s Commercial Courts in the Nineteenth Century« -- The present book explores the extent of influence which French law had on the development of Germany’s commercial courts in the nineteenth century. The literature describes this influence as marginal, yet without further proof. The author takes this state of research as a starting point to compare the Napoleonic legislation on commercial courts with the German commercial court systems of the nineteenth century.
