Die Einstellung des Mannesmann-Verfahrens im November 2006 hat die Diskussion über den "Deal" im Strafverfahren erneut angefacht. BGH-Präsident Hirsch schlug im Anschluss an die Absprache im Fall Hartz, welcher unlängst mit einer Bewährungs- und Geldstrafe endete, gar eine mögliche Kontrolle aller Urteilsabsprachen durch die Generalbundesanwaltschaft vor. Verschiedene Kodifizierungsvorschläge für die Urteilsabsprache stehen gleichfalls im Raum. Oberstaatsanwalt Peter Lichtenberg (Düsseldorf), Vertreter der Anklage in der Neuauflage des Mannesmann-Verfahrens, und Prof. Dr. Thomas Rönnau (Hamburg) führten im Januar 2007 ein Streitgespräch über dieses hochaktuelle Thema.
