    Content: Diversity and the Justice System in Japan The comprehensive reform of the justice system, undertaken in Japan during the first decade of this new century, on the one hand illustrates how law reacts to increasing diversity in society, and on the other emphasizes how law itself often fosters diversity. In the Recommendations of the Justice System Reform Council (JSRC) of 2001, which have served as a blueprint for the reform, diversification (tayōka) constitutes as a key term, even if it remains somewhat ambiguous. For the JSRC, the increasing diversity in Japanese society, interlinked with the de-regulation resulting from earlier reforms, is given as the main reason why the Japanese justice system needs fundamental reform in order to meet the growing and diversifying demand foreseen for the new century. But diversity, at the same time, is also a major element in the measures taken by the legislator in order to eliminate the shortcomings of the status quo. Within the first of the three »columns« of the reform, which aims to adjust the institutions of the justice system to meet public expectations, one vital element is the diversification of dispute resolution. The reform, therefore, has not only brought about major changes to court proceedings, but has simultaneously aimed to strengthen various forms of alternative dispute resolution (ADR), such as commercial arbitration, private mediation, and the conciliation of labor disputes. In this respect, the reform has, to date, produced mixed results. Diversification, furthermore, is an important catchword within the reform’s second column, which is devoted to the legal profession and legal education. The latter arguably constitutes the pivotal, and certainly the most controversial, part of the reform. Increasing the number of legal professionals, which by international standards has long been extraordinarily small in Japan, together with applying certain other measures, has led to a certain diversification of the legal profession and legal services. With regard to the targets for the candidates who may successfully pass the national bar examination, however, the JSRC’s recommendations have been followed only in part, but not least, due to political pressure from the Japanese bar. This, in turn, has exacerbated the crisis surrounding newly-established law schools and, so far, has significantly hampered the diversification of legal education. According to the ambitious aims of the JSRC, the justice reform was not only established to react to the increasing diversity in Japanese society by comprehensively strengthening the justice system; it was also supposed to accomplish nothing less than finally implanting the rule of law deeply within Japanese society. With regard to the diversification of the services offered by the justice system, these goals have, to date, been realized only in part.

    Content: The Destruction of the Security »Myth«: The Feeling of Insecurity as It Is Understood by Private Security Companies in Japan Although the crime rate in Japan has been decreasing since 2002, the feeling of insecurity (taikan chian) in Japanese society has not been improving to the same extent. While private security companies can offer their clients services to prevent threatening risks from happening, they have had to deal with a reluctant public ever since their establishment in the 1960s. In popular discourse, security has often been taken for granted and considered to be a service that should not be paid for. By successfully providing a secure environment at major events such as the Ise-Shima Summit in 2016, however, private security companies are increasingly able to build trustful relationships with local police and citizens. In this paper, I am going to explain how views on security and risk are being put forward by these firms. I tackle this question by conducting a discourse analysis of articles published in newspapers and magazines specialized in this business sector. I refer to Olaf Corry’s approach of riskification as a suitable framework for showing the complex processes of how notions of security are being shaped. I shall conclude that joint statements from representatives of the police and private companies play a crucial role in constructing what is being perceived as a risk. In the articles, recent positive developments have been acknowledged, but special forms of crime are nevertheless seen as a challenge to Japanese society. Only by working together with local communities and private actors, can the aim for a »society without crime« be considered achievable. Thus, security firms are becoming more and more involved in actions that offer security not only to their clients, but to society in general. Considering these developments, it is questionable whether the monopoly over physical power as explained by Max Weber is still accurate.

    Content: Recent Developments and Trends in Japanese Foreign Policy 2017/2018: A Strategic Turning Point for Japan? The most important issues regarding Japan’s foreign and security policy in 2017 and 2018 were the North Korean Nuclear and Missile Crisis, the upcoming trade conflict with the US, the finalization of the free trade agreement with the EU, and the further promotion of Japan’s new »Free and Open Indo-Pacific« strategy. Furthermore, there have been strong signs of rapprochement between Japan and China as well as between Japan as Russia, although there are still matters for concern between both countries. This article analyzes these developments and examines Japan’s bilateral relations with its most important partners, as well as its security, international trade and development policy.

    Content: Domestic Politics 2017/18 This chapter summarizes major developments in Japanese domestic politics from September 2017 through to August 2018. During this period, Prime Minister Abe dissolved the Lower House to call a snap election, which led to the third straight LDP victory in the Lower House elections since 2012. This victory, just like the election outcomes in 2012 and 2014, was less the result of high approval ratings than a, yet again, divided opposition. The largest opposition party had split right before the election, with the aim of creating a competitor for the LDP, led by Ms. Koike. This strategy, however, failed to produce the desired results from the perspective of the opposition parties. After introducing this new party landscape, this chapter will also examine some important legislative initiatives and developments in the Kake and Moritomo scandals.

    Content: QUAD and the Indo-Pacific Concept: Attempts to Contain China’s Endeavour for Hegemony This article shall attempt to explain the Indo-Pacific concept and the Quadrilateral Security Dialog QUAD to counter China’s aim to become Asia’s hegemon. Japan, India, Australia and the USA are members of the QUAD. The traditional Asia-Pacific policy between the USA and Japan did not include the region of the Indian Ocean, which includes states such as India and Bangladesh. The Indo-Pacific Concept aims to integrate the countries of South, South East and East Asia under liberal order and the rule of law. Japan is the driving force of this policy. However, Japan and the other countries must face the issue that these same countries, who wish to hinder the PR China and their aim to become the economic and military super power of Asia, are also economically deeply intertwined with China. Hence, although China is building military bases in the Indian and Pacific Ocean and in the South China Sea, QUAD members do not want to appear to be a similar group as NATO or an adversary of the PR China. The second problem for Japan and the other Asian countries is the USA. In the past, the USA has been the leading nation in Asia in terms of security and economic policy. However, this is not a guaranteed policy for the future. Japan, Australia and India see the Indo-Pacific concept and QUAD as a way to deal with China, even if the USA will no longer represent the economic leader and military guarantor for these Asian countries.

    Content: Rightwing Populism in Japan: Analysis of Japanese Blogs regarding the Nippon Ishin no Kai In recent years, populist movements have gained massive support in various parts of the world. In Japan, the rightwing populist party Nippon Ishin no Kai became the third strongest force in the 2012 national elections, just months after their formation. Party leaders Tōru Hashimoto and Shintarō Ishihara were able to benefit from the rising mistrust and disappointment in political leaders, and so Nippon Ishin no Kai became a political alternative and a threat to established parties. In the course of their careers, the two leaders have gained particular media attention by releasing several highly controversial statements concerning Japanese security policy as well as foreign relations within East Asia. As a result, Tōru Hashimoto and Shintarō Ishihara have become highly polarizing figures. While recent studies on populism in Japan focus on the electoral success and populist agenda of Hashimoto and Ishihara, the following essay shall attempt to analyze the public debate around the Nippon Ishin no Kai and its leaders. By analyzing topics and characteristics of the debate held on Japanese blog servers using the digital analysis tool TopicExplorer, this essay will show how this populist agenda has influenced discourse in the Japanese blog scene. This shall clarify the central topics and elements of public discourse.

    Content: Between Security Policy and Peace Movements: Contemporary Contentious Politics surrounding the US Military Base Construction in Okinawa Prefecture This paper shall examine the contentious political process for the construction of US military bases in Okinawa Prefecture since the 1990s. The political relationship, as well as the bilateral Status of Forces Agreement between the Japanese and US government, particularly from the perspective of international relations, has been widely argued. Previous research, however, lacks discussion about the local contentious mobilization processes that, consequently, tend to reduce actual problems on the international dimension. To overcome this shortage, the perspective of contentious politics, conceptualized by the political sociologist Charles Tilly and other researchers, introduces the possibility of delineating the multiple dimensions of political mobilization that are not limited to party politics, but incorporates challenges to political institutions. The political influence of security policy varies in accordance with local situations. There is, therefore, a need to precisely analyze local responses. Firstly, based on the relevant sociological fieldwork, the study investigates conditions of the emergence of the local protest by conducting a case study of Takae on the northern Okinawa Island. Secondly, the study clarifies a drastic escalation of the protest in 2016 from media analysis.

    Content: The New Spirit of Capitalism in Japan? The theory of the »New Spirit of Capitalism« as elaborated by Luc Boltanski and Eve Chiapello (1999), has not received very much attention in Japan so far. Nonetheless, this »new spirit« is spreading in Japan as well as in Western countries. It may be more difficult to observe this occurrence in Japan, however, because of the fact that traditional structures, management methods and gratification systems are still predominant in and represented by extended enterprises, which have been the center of attention for foreign researchers for decades. The article starts with a short summary of the »New Spirit of Capitalism« theory and clarifies some of the literature which focuses on this topic in Japan. Next, the article outlines the eminent characteristics of the Japanese management and gratification system and its historical basis. These are contrasted with case studies of startup entrepreneurs, their biographies, ideas and principles of management. Some of them have been extraordinarily successful in managing to build up a new company, mostly in the IT, finance or insurance sectors. It is emphasized that these entrepreneurs represent the »New Spirit of Capitalism« in Japan and, despite being few in number, are exerting enormous influence on economic and educational politics.
