Improving consumer protection in the Western Balkans in accordance with European Union standards

Sažetak
Tema rada je unapređenje zaštite potrošača u zemljama Zapadnog Balkana, u kontekstu održive strategije za stalno unapređenje statusa potrošača, njihovih prava, potreba i zahteva, a u skladu sa standardima Evropske unije. Predmet istraživanja je sistem zaštite potrošača, kao esencijalne komponente uspostavljanja institucionalnog ambijenta moderne tržišne privrede u ovim zemljama i potrebe stalnog proširenja ovog segmenta komunitarnog prava. Cilj ovog rada je da prikaže dosadašnja dostignuća u sferi zaštite potrošača u zemljama Zapadnog Balkana, kao i da ukaže na probleme i poteškoće koji su evidentirani u određenim segmentima sprovođenja osnovnih načela, principa, obaveza i zakonske regulative u ovoj oblasti. Parametri korišćeni za komparativnu analizu baziraju se na osnovnim principima koji sačinjavaju pravno-ekonomski sistem zaštite potrošača u EU. Ključna hipoteza od koje se u radu polazi je da postojeća zakonska regulativa u ovim zemljama može da posluži kao dobra osnova za dalje unapređenje zaštite potrošača, ali je potrebna veća aktivnost i zalaganje svih relevantnih aktera, vladinih institucija i subjekata civilnog društva, imajući u vidu da je visok nivo zaštite potrošača cilj kojem teže zemlje Balkana u uslovima evropskih integracija. S obzirom na predmet, cilj i postavljene hipoteze, u radu je primenjena kvalitativna metodologija, bazirana na proučavanju i deskriptivnoj analizi definisanog problema, uz primenu uobičajenog naučno-istraživačkog instrumentarijuma. Analiza relevantne literature, publikacija međunarodnih organizacija, zakonskih dokumenata i empirijskih istraživanja, ukazala je da su zemlje Zapadnog Balkana definisale svoje politike zaštite potrošača, u skladu sa evropskim standardima, ali da su im, kao zemljama kandidatima ili potencijalnim kandidatima za članstvo u EU, neophodni efikasniji mehanizmi za njihovo ostvarivanje u praksi, kako bi potrošači na Balkanu dostigli nivo zaštite evropskih potrošača. Rad se, nakon uvoda, sastoji iz sledećih delova: Pregled dosadašnjih istraživanja sa metodologijom; Komparativna analiza zaštite potrošača u zemljama Zapadnog Balkana; Šire obrazloženje rezultata komparativne analize; Postignuti nivo javne svesti potrošača o njihovim pravima, i Zaključna razmatranja.
