Inhalt: Anyone who visits Berlin’s Olympic Park will inevitably stumble across the continued effects of the site's Nazi monumentality—and also its largely unbroken tradition of ethnic and anti-Semitic monumentality. The criticism of this is diverse, but so far rather loosely interwoven: Where does the debate stand—or, indeed, where do the debates stand? What views are there from the perspectives of history, museums, art, politics, sport or monument protection? Where can bridges of criticism be built, where are the different perspectives contradictory, and where is fundamental reorientation or readjustment of the debate(s) required? This anthology attempts to address these questions, not only to outline or initiate paths of debate but also to identify fundamental problems.

Inhalt: Gender order is one domain in which claims to power are demarcated in societies based on a religious codex as well as in secular societies such as nation-states. Gender order especially becomes the area in which conflicts are carried out when a society experiences transition or clashes with another society. At a time when Israel and Palestine face an escalation of their conflict and Germany is undergoing profound changes, renowned scholars discuss the implications on the gender order from their individual vantage points. The transdisciplinary articles focus on Gender in the context of Knowledge, Arts and Representation, Memory and Scripture, Political Transition, and Life Sciences.

Serie: Max Planck trialogues on the law of peace and war ; 4
Inhalt: In the past decade, numerous military operations by outside states have relied on the real or alleged 'invitation' of one of the parties. In this book, three experts examine the relevant legal issues, from sovereignty to the scope and relevance of consent, the use of force to the role of the Security of Council. Using critical historical analysis, qualitative case studies and large-N empirics, these topics are debated and addressed in a unique trialogue format. Accommodating the pluralism of the field, the trialogical setting highlights the divergences and commonalities of each of the three approaches. Benefiting from an in-depth analysis of recent cases of armed intervention and the diversity of the authors' perspectives, this collection is key to developing a richer understanding of the law of military intervention. This title is also available as Open Access on Cambridge Core.

Inhalt: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.
