Particularly, how to deal with burdens on creditors that arise while waiting for assumption or rejection. It contains an assessment of whether bankruptcy law should be supplemented by new compensation regimes. In doing so, the author draws on all sources available to legal scholars: Legal history, systematic considerations, comparisons within the legal system.     Content: Die Arbeit greift das weitgehend ungelöste Problem auf, wie mit Belastungen der Vertragspartner des Insolvenzschuldners umzugehen ist, die beim Warten auf die Entscheidung nach § 103 InsO entstehen. Es wird geprüft, ob das Insolvenzvertragsrecht um neue Ausgleichsinstitute ergänzt werden sollte. Dabei schöpft die Verfasserin aus allen Quellen, die rechtswissenschaftlicher Arbeit zur Verfügung stehen: Rechtsgeschichte, systematische Überlegungen, Vergleiche innerhalb der Rechtsordnung und zu anderen Rechtssystemen. Ein Rückblick zeigt, dass sich die verfahrensbedingten Belastungen in den letzten Jahrzehnten intensiviert haben. Die Verfasserin erkennt das Reformbedürfnis und stellt einen Gesetzesentwurf zur Ergänzung des § 103 InsO vor
