Inhalt: "Impressively researched and written with the linguist's precision and flair for language, World Orders Old and New offers a stimulating, fresh perspective from which to view an intellectual culture defined by such dubious political critics as Rush Limbaugh and Dan Quayle."--BOOK JACKET
Inhalt: "Noam Chomsky, the left's leading critic of government policy, power, and language, takes on the international scene since 1945, devoting particular attention to events following the collapse of the Soviet Union. In World Orders Old and New, he develops an eloquent, incendiary, and forceful critique of Western government, from imperialist foreign policies to the Clinton administration's empty promises to the poor." "Chomsky offers a skeptic's guide to the modern language of power, taking readers on a journey through the Middle East, Central America, Eastern Europe, and other regions of the world where the U.S. makes myriad efforts to "maintain stability" or "restore hope." World Orders Old and New introduces readers to the so-called New World Order, where hopes for international peace and democracy have been challenged by numerous outbreaks of ethnic and regional violence." "With characteristic freshness and intensity, Chomsky reviews the history of superpower efforts to check territorial aggression, citing the war in the Gulf as a prime example of Western bravado, and examines these efforts from his own unique political perspective." "Turning to America, he uncovers the disappointments and doublespeak of the Clinton administration's domestic economic program. In Chomsky's view, the current president's hypocrisy is matched only by the distortions of his policies by the media, especially the New York Times." "Concluding with an assessment of the recent Israeli-Palestinian accord - in which Chomsky expresses concern for the victimization of the Palestinians - this major thinker of our time focuses his no-holds-barred attention once more on the powerless, the power-hungry, and the power-mongers in our increasingly global community

Inhalt: The well-being of individuals routinely depends on their success in obtaining burdens distributed by society. Local justice offers the first systematic analysis of the principles and procedures used in dispensing "local justice" in situations as varied as the admission of students to college, the choice of patients for organ transplants, the selection of workers for layoffs, and the induction of men into the army. A prominent theorist in the field of rational choice and decision making, Jon Elster develops a rich selection of empirical examples and case studies to demonstrate the diversity of procedures used by institutions that mete out local justice. From this revealing material Elster fashions a conceptual framework for understanding why institutions make these crucial allocations in the ways they do
Inhalt: Elster's investigation discloses the many complex and varied approaches of such decision-making bodies as selective service and adoption agencies, employers and universities, prison and immigration authorities. What are the conflicting demands placed on these institutions by the needs of applicants, the recommendations of external agencies, and their own organizational imperatives? Often, as Elster shows, methods of allocation may actually aggravate social problems. For instance, the likelihood that handicapped or minority infants will be adopted is further decreased when agencies apply the same stringent screening criteria--exclusion of people over forty, single parents, working wives, and low-income families--that they use for more sought after babies. Elster proposes a classification of the main principles and procedures used to match goods with individuals, charts the interactions among these mechanisms of local justice, and evaluates them in terms of fairness and efficiency
Inhalt: From his empirical groundwork, Elster builds an innovative analysis of the historical processes by which, at given times and under given circumstances, preferences become principles and principles become procedures. Local Justice concludes with a comparison of local justice systems with major contemporary theories of social justice--utilitarianism, John Rawls's A Theory of Justice, Robert Nozick's Anarchy, State and Utopia--and discusses the "commonsense conception of justice" held by professional decision makers such as lawyers, economists, and politicians. The difference between what we say about justice and how we actually dispense it is the illuminating principle behind Elster's latest work

Inhalt: Since 1996, death sentences in America have declined by more than 60 percent, reversing a generation-long trend toward greater acceptance of capital punishment. In theory, most Americans continue to support the death penalty. But it is no longer seen as a theoretical matter. Prosecutors, judges, and juries across the country have moved in large numbers to give much greater credence to the possibility of mistakes - mistakes that in this arena are potentially fatal. The discovery of innocence, documented in this book through painstaking analyses of media coverage and with newly developed methods, has led to historic shifts in public opinion and to a sharp decline in use of the death penalty by juries across the country. A social cascade, starting with legal clinics and innocence projects, has snowballed into a national phenomenon that may spell the end of the death penalty in America.

Inhalt: In an ideal democracy, people from all walks of life would come together to talk meaningfully and respectfully about politics. But we do not live in an ideal democracy. In contemporary democracies, which are marked by deep social divisions, different groups for the most part avoid talking to each other. And when they do talk to each other, their speech often seems to be little more than a vehicle for rage, hatred, and deception. 0Democratic Speech in Divided Times argues that we should nevertheless not give up on the ideal of democratic public speech. Drawing on the resources of political theory, epistemology, and philosophy of language, this book develops a sustained account of the norms that should govern public discourse in deeply divided circumstances. Should we try to find common ground when we talk to our political opponents, even though they seem unreasonable? Should we refrain from expressing anger, if we want to get things done? How can we use our speech to fight hate speech and disinformation? And is it even possible to speak to 'the other side,' in settings where different groups dislike one another, live apart from one another, and don't know much about one another? By tackling these questions, Lepoutre demonstrates that, when governed by the right set of norms, public speech can be a powerful force for good even amidst profound social divisions

Inhalt: The rise of Euroscepticism and populist backlash pose a dramatic challenge to the EU and highlight the EU's growing legal powers over core areas of state sovereignty. Authored by leading academics and policymakers, this book provides a comprehensive and cutting-edge analysis of the fields of EU law at the heart of contemporary political debates - economic policy, human migration, internal security, and constitutional fundamentals at the national level. Following the specialist contributions, the conclusion draws out critical, cross-cutting lessons for improving legitimacy and advancing the rule of law, rights and democracy in sovereignty-sensitive areas of EU law. Accessible to students, this volume is an invaluable resource for researchers and scholars of EU law and politics.

Serie: The law in context series
Inhalt: Can the concept of law be indiscriminately extended to times and places in which it did simply not exist? Such an extension is at best useless and at worst misleading. Producing an intelligible jurisprudence of the concept of law means keeping it within the reasonable boundaries of its contemporary common-sense understanding: positive law. Parallel to Western societies in which it firstly emerged, the concept of positive law developed in many places, including countries characterized as Muslim. There, it faced other existing normativities, like customs and the Sharia. This book aims, from the Muslim world's perspective, to clarify the uses of the concept of law and the ways of studying it, to describe some of its historical developments, including the ideas of constitutional law, customary law and forensic evidence, and to describe present-day practices, including reference to law sources, rules and interpretation.

Inhalt: International commitments may sit uneasily with national pressures in the best of times. This age of economic uncertainty brings these tensions into sharper relief. This volume draws together thirteen analyses of this tension in a wide array of contexts, including each of the three main pillars of the World Trade Organization, international investment law and arbitration, and the international financial institutions. The essays feature internationally recognised experts addressing topical examples of international economic law obligations clashing with domestic political interests. For example, Professor Robert Howse, of New York University Law School, addresses issues of globalization and whether international and national interests can in today's world be considered separate, while Ko-Yung Tung, the former Director-General of the World Bank, looks at trends in investment treaty arbitration and considers what the future may hold in light of the recent financial crisis, the rise of China as an economic powerhouse, and other factors.

Inhalt: By definition, international law, once agreed upon and consented to, applies to all parties equally. This book explains that states at times adhere to similar, and at other times, adopt different interpretations of the same international norms and standards. This work achieves three objectives. The first is to show that international law is not a monolith. The second is to map the cross-country similarities and differences in international legal norms in different fields of international law, as well as their application and interpretation with regards to geographic differences.
