Implizite Vorurteile beeinflussen Arbeitgeberentscheidungen auf unbewusster Ebene. Ausgangspunkt der Untersuchung war die Frage, inwiefern der vorvertragliche Diskriminierungsschutz des AGG den Einfluss impliziter Vorurteile auf den Entscheidungsprozess des Arbeitgebers bei der Personalauswahl erfasst und ob das Regelungsregime des AGG ein wirksames und verhältnismäßiges Instrument zu deren Reduzierung bereithält. Zur Analyse des subjektiven Benachteiligungstatbestandes unterteilt der Autor den Entscheidungsprozess in Motivebene und Anknüpfungsebene, um anschließend eine Verortung impliziter Vorurteile auf Tatbestands- und Rechtfertigungsebene vorzunehmen. Auf Rechtsfolgenseite erweist sich insbesondere die verschuldensunabhängige Sanktion in § 15 Abs. 2 AGG als ungeeignet, dem Einfluss impliziter Vorurteile wirksam zu begegnen
