Eine der juristisch anspruchsvollsten und politisch langwierigsten Aufgaben des Einigungsprozesses ist die Abwicklung des Volkseigentums der DDR. Ein besonderes Spannungsverhältnis entstand zwischen der Veräußerung des volkseigenen Vermögens an private Investoren und der Übertragung auf kommunale Gebietskörperschaften. Brisant bleibt bis heute die Frage, ob der Verkauf des sozialistischen Wirtschaftserbes vielfach auf Kosten der ostdeutschen Kommunen vorgenommen worden ist. -- Privatisierung versus Rekommunalisierung beschreibt den entscheidenden Konflikt, der die Vermögensausstattung der Gemeinden, Städte und Kreise nach der Wende prägte. Die Treuhandanstalt/BvS hat vor allem in den Jahren 1990 bis 1993 kommunal beanspruchbare Vermögensgegenstände oftmals "mit" veräußert. Betroffene Gebietskörperschaften beziffern ihren Schaden auf insgesamt 600 Mio. DM. Später ordnete die Treuhandanstalt/BvS privat erworbene Vermögensgegenstände "nachträglich" Gemeinden, Städten und Kreisen zu - ein Vorgehen, das die Gerichte bis heute beschäftigt. -- Die Autorin untersucht, ob die Tätigkeit der Treuhandanstalt/BvS dem Pflichtenkonflikt zwischen Privatisierung und Rekommunalisierung nach rechtsdogmatischen Grundsätzen gerecht geworden ist. Im Mittelpunkt der Erörterung stehen Privatisierungs- und Rekommunalisierungsauftrag, ihre inhaltliche Ausgestaltung sowie der Überschneidungsbereich beider Aufträge. Claudia Danker fragt, welches Verhalten von der Treuhandanstalt/BvS zur Bewältigung des Konflikts zu fordern war und inwieweit betroffene ostdeutsche Kommunen Schadensersatz verlangen können. -- Die Arbeit wurde ausgezeichnet mit der Luther-Urkunde der Martin-Luther-Universität Halle-Wittenberg.
