Im modernen, von Arbeitsteilung geprägten Wirtschaftsleben nehmen auch Straftäter zur Begehung ihrer Tat Leistungen anderer Personen in Anspruch. Von großer praktischer Relevanz sind etwa der Transfer von Geldern ins Ausland durch Bankangestellte, den der Kunde später zur Steuerhinterziehung nutzt, die Einrichtung eines Kontos, über das der Kunde betrügerische Geschäftsbeziehungen abwickelt oder der Verkauf von Tabakwaren an Händler, die diese später unter Verletzung von Steuer- und Zollvorschriften veräußern. -- In solchen Fällen ist fraglich, wann sich derjenige, der an den Täter nur seine üblichen beruflichen Leistungen wie an jedermann sonst erbringt, selbst strafbar macht: Nach allgemeinen Grundsätzen scheint hier auf den ersten Blick eine weitreichende strafrechtliche Verantwortlichkeit des Berufsträgers nahe zu liegen, die jedoch vielfach für unangemessen gehalten und seit einigen Jahren in Literatur und Rechtsprechung kontrovers diskutiert wird. -- Ausgehend von der Phänomenologie berufsbedingter Unterstützungshandlungen sowie unter Einbeziehung von rechtstheoretischen, verfassungsrechtlichen und strafrechtsdogmatischen Grundlagen entwickelt Hans Kudlich ein Modell für das Handeln in sich überschneidenden Verantwortlichkeitskreisen und unterbreitet differenzierende Lösungsvorschläge zum Problem berufsbedingter Unterstützungshandlungen.
