Open Source Software ist im deutschen Urheberrecht angekommen. Der Gesetzgeber hat mit der Regelung in § 32 Abs. 3 Satz 3 UrhG die besonderen Bedürfnisse von Copyleft-Lizenzierungsmodellen berücksichtigt. Eine Verknüpfung von eingeräumten Nutzungsrechten und den in der GPL festgelegten Nutzungspflichten erfolgt im Wege der Vereinbarung einer auflösenden Bedingung gem. § 158 Abs. 2 BGB. Bei dem der Nutzungsrechtseinräumung zugrunde liegenden Verpflichtungsgeschäft handelt es sich um einen atypischen "Open Source"-Vertrag, wobei sich der Vertragsinhalt im Wesentlichen aus den jeweiligen Lizenzbedingungen entnehmen lässt, die als AGB einzuordnen sind. -- Der in Open Source-Verträgen formulierte Gewährleistungs- und Haftungsausschluss verstößt gegen §§ 305 ff. BGB. Somit lässt sich die Haftung allein auf leichte Fahrlässigkeit beschränken - Grund genug, sich mit dem Thema auseinanderzusetzen.
