Die neue EU-Vergaberichtlinie muss bis 2016 durch die Mitgliedstaaten umgesetzt werden. Das wesentliche Anliegen der Reform ist die stärkere Berücksichtigung sozialer Belange bei der Vergabe öffentlicher Aufträge. Hauptakteur bei der Stärkung sozialer und ökologischer Gesichtspunkte war das Europäische Parlament. Die Richtlinie enthält einige zwingende Verschärfungen. Vor allem eröffnet sie aber den Mitgliedstaaten grössere Spielräume bei der Umsetzung. Diese können den öffentlichen Auftraggebern beispielsweise vorschreiben, dass sie bei der Vergabe nicht nur den Preis zugrunde legen dürfen, sondern zwingend soziale und ökologische Kriterien einbeziehen müssen. Inwieweit das Ideal einer strategischen Beschaffung in der sozialen Wirklichkeit ankommt, liegt somit weitgehend in der politischen Verantwortung der mitgliedstaatlichen Gesetzgeber
