Die Arbeit untersucht anhand der Manipulationen bei der Leberallokation, ob die hierdurch potentiell bewirkte Umverteilung von Lebenschancen als vollendetes oder versuchtes Tötungs- oder Körperverletzungsdelikt zum Nachteil davon betroffener Patienten bewertet werden kann. Es wird sich zeigen, dass ein vollendetes Delikt bereits am Kausalitätsnachweis scheitert.Der Fokus liegt deshalb auf dem Versuch und hier vor allem auf vier Fragen: Erstens, ob die derzeitigen Organvermittlungsregelungen verfassungswidrig sind, was bejaht wird. Zweitens, ob dies einer strafrechtlichen Bewehrung eines Verstoßes hiergegen entgegensteht, was verneint wird. Drittens, inwiefern derartige Lebens- und Gesundheitschancen verteilende Normen das individuelle Leben Betroffener schützen, was bejaht wird. Viertens schließlich, ob sich plausibel annehmen lässt, dass ein manipulierender Arzt den Tod benachteiligter Patienten für möglich hält und billigt, was regelmäßig zu verneinen ist.
