Alles positive Recht ist temporär und disponibel. Deswegen ist die Zukunfts- und Rückwirkung des Rechts selbst ein allgemeines rechtliches Phänomen, das nicht nur Gesetze und Verwaltungsakte, sondern auch Gerichtsentscheidungen, dann nämlich bei der Frage der Rechtsprechungsänderung betrifft. In dem Problem, ob eine Rechtsprechungsänderung rück- oder zukunftswirkend durchgeführt wird, stehen sich zwei unserer Rechtsordnung immanente Prinzipien, namentlich Rechtskontinuität und Rechtsentwicklung, gegenüber. Die Lösung dieses Problems muss den vermeintlich unmöglichen Weg beschreiten, beide sich widersprechenden Prinzipien miteinander in Einklang zu bringen. Die Rechtsprechungsänderung mit Wirkung für die Zukunft vermag dies. Hierzu muss erstens die verfassungsrechtliche und rechtslogische Möglichkeit bestehen, dass eine Rechtsprechungsänderung für die Zukunft ausgesprochen wird und zweitens muss sich diese bloße Möglichkeit in anhand von gewissen Kriterien bestimmten Fallkonstellationen zu einer Notwendigkeit konsolidieren lassen. Maßgebliche Begründung hierfür ist der auch vom Bundesgerichtshof herangezogene Vertrauensschutz.
