Wie beeinflusst der Zeitgeist die Rechtsanwendung - und umgekehrt? Dieser Frage geht Tobias Singelnstein aus einer interpretativen kriminologischen Perspektive am Beispiel der Strafrechtsanwendung nach. -- Der Autor entwickelt ein Konzept außergesetzlicher Anwendungsregeln, die die Rechtsanwendung leiten und so außerrechtliche Einflüsse in den Kriminalisierungsprozess transportieren. Diesen Ansatz verbindet er mit der sozialwissenschaftlichen Diskursanalyse im Anschluss an Foucault. Danach können gesellschaftliche Wissensbestände als interpretativer Rahmen von Kriminalisierungsprozessen verstanden werden. Mit diesem Modell analysiert Singelnstein, wie gesellschaftliche Vorstellungen über Kriminalität die Rechtsanwendung prägen und welchen Einfluss diese Praxis wiederum auf gesellschaftliche Vorstellungen hat. Er erklärt so, wie inhaltliche Grundlagen für die Zuschreibung im Kriminalisierungsprozess gebildet werden und wie sie über die herausgearbeiteten Anwendungsregeln in die Rechtsanwendung gelangen. Von diesen Befunden ausgehend widmet er sich sodann dem Aspekt der Macht, die der Rechtsanwendung im Kriminalisierungsprozess angesichts dessen innewohnt. Hierfür zieht er den Ansatz der Gouvernementalität heran. Damit legt der Autor eine in der "Recht und Gesellschaft"-Forschung zu verortende Arbeit vor, die die in den Sozialwissenschaften vieldiskutierten Konzepte der Diskursanalyse und der Gouvernementalität für die Kriminologie, die Rechtstheorie und -soziologie fruchtbar macht.
