Roman Alexander Kasten widmet sich den durch die Richtlinie über Märkte für Finanzinstrumente (MiFID) reformierten Pflichten von Dienstleistern bei der Vermögensanlage der Kunden. Dabei untersucht er mittels einer ökonomischen Analyse des Anlegerverhaltens sowohl die menschliche Psychologie als auch Probleme von Informationsasymmetrien. Der Autor weist nach, dass es den homo oeconomicus nicht gibt und leitet hieraus ein Informationsmodell ab. -- Kasten beleuchtet anschließend, welche Änderungen die MiFID bewirkt hat. Nach der Bestimmung des Kundenprofils (geeignete Gegenpartei, professionelle Kunden, Privatkunden, § 31a WpHG) folgt ein Informationsmodell, welches je nach Geschäft (Anlageberatung, Vermögensverwaltung, beratungslose Wertpapierkäufe, Execution-only-Business) unterscheidet. Ein vom Autor entwickeltes Filter-Modell macht deutlich, dass die holzschnittartige Informationsverpflichtung durch die Einstufung in Kundenmodelle (Filter 1) und die Differenzierung nach der Geschäftsart (Filter 2) passgenaue Ergebnisse liefert. -- Aufgrund der Legion an Rechtsprechung untersucht Kasten die Streitfälle zum alten Recht. Die Untersuchung zeigt die nunmehr überkommenen Probleme auf. Die Arbeit schließt mit einer Untersuchung zur Haftung von Wertpapierdienstleistern.
