Der Ausschluss eines Fraktionsmitgliedes aus der Fraktion schmälert die politischen und parlamentarischen Handlungsmöglichkeiten eines Abgeordneten nicht unerheblich. Dabei wird die seitens der Fraktionsmitglieder in Ausübung ihres freien Mandats getroffene Entscheidung zur Kooperation durch die Ausschlussentscheidung der Fraktionsmehrheit einseitig aufgehoben. Alexandra Bäcker legt dar, dass die aus dem freien Mandat der Mitglieder folgende Befugnis der Fraktion, in die personelle Zusammensetzung der Fraktion durch Ausschluss einzelner Abgeordneter korrigierend einzugreifen, ihre Rechtfertigung und zugleich ihre Begrenzung erfährt durch das verfassungsrechtlich legitimierte Interesse, sich gegen Beeinträchtigungen der Funktionserfüllung zu wehren. Ausgehend hiervon und orientiert an der Realität des Fraktionsgeschehens werden aus der Verfassung rechtliche Maßgaben des Ausschlussverfahrens entwickelt. Mit der Arbeit am Detail trägt die Untersuchung weiter bei zu einem angemessenen grundsätzlichen Verständnis der Fraktionen.
