Vor dem Hintergrund der prozessualen Darlegungs- und Beweislast und des strukturellen Informationsdefizits des Rechtsinhabers bei einer vermuteten Schutzrechtsverletzung untersucht Thomas Gniadek zunächst die nach bisherigem deutschen Recht bestehenden materiellen Ansprüche – z.B. § 809 BGB – und prozessualen Instrumente – z.B. §§ 142, 144 ZPO, §§ 485 ff. ZPO – zur Informationsbeschaffung und Beweissicherung im gewerblichen Rechtsschutz und Urheberrecht, sowie die Lehre von einer prozessualen Aufklärungspflicht der Parteien. -- Sodann erfolgt eine detaillierte Analyse der mit Art. 6 und 7 der »Enforcement«-Richtlinie bereitgestellten Instrumente zur Informationsbeschaffung unter Heranziehung des französischen und des englischen Rechtsinstituts der »saisie« und der »search order«. -- Schließlich zeigt der Autor, wie eine richtlinienkonforme Auslegung des neu geschaffenen Besichtigungsanspruchs nach § 140c PatG zu einem effektiven Instrument der vorprozessualen Informationsbeschaffung führt, welches Elemente der Beweisermittlung und Möglichkeiten des Schutzes der Betriebsgeheimnisse des mutmaßlichen Verletzers bereithält.
