Spätestens seit dem wegweisenden BGH-Urteil im »Fuldaer Fall« steht die Sterbehilfe wieder im rechtswissenschaftlichen Fokus; gleichzeitig fühlt sich auch der Gesetzgeber in der Pflicht, wie die Diskussion um die Strafbarkeit bestimmter Formen des assistierten Suizids belegt. -- Die Sterbehilfe gilt hierzulande nach wie vor als eine Domäne des Strafrechtlers. Wie lässt sich das Spannungsverhältnis zwischen Selbstbestimmung und Lebensschutz auflösen? Im Gegensatz zu Deutschland, wo es bis heute keine spezialgesetzliche Regelung der Problematik gibt, hat Ungarn im Zuge der Systemtransformation nach dem Fall des Eisernen Vorhangs auch das Gesundheitswesen grundlegend umgestaltet und das Verhältnis zwischen Arzt und Patient auf eine neue sondergesetzliche Grundlage gestellt, die auch Vorschriften zur Sterbehilfe umfasst. Die Arbeit geht der Frage nach, welche der beiden Rechtsordnungen eine »bessere Lösung« der zahlreichen diffizilen Probleme bietet, die Entscheidungen am Lebensende anhaften. / »Euthanasia and Criminal Law: A Comparative Analysis between Germany and Hungary« -- The issue of euthanasia is more relevant than ever. How can the tension between personal autonomy and the protection of life be dissolved? While the German legislature has left this problem field to jurisprudence and doctrine, in Hungary a law came into effect in 1998, which regulates in detail the relationship between doctor and patient and also contains rules on euthanasia. In his work, Richard Ehmann analyses which of the two legal systems provides a »better solution« to the intricate questions revolving around life and death.
